1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your use of https://alenabrowart.com and its related pages, forms, links, and online features (collectively, the “Site”).

By accessing or using the Site, submitting an inquiry, or booking a service or training through a link provided on the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. About Alena Brow Art

Alena Brow Art is operated by Alena Erdyneeva, doing business as Alena Brow Art, a sole proprietorship based in New York City.

We provide natural permanent makeup services, consultations, professional education, workshops, and private training.

3. Eligibility

You must be at least 18 years old to receive permanent makeup services from Alena Brow Art.

By using the Site or booking a permanent makeup appointment, you represent that you are legally able to enter into an agreement and meet all applicable age requirements.

Participation requirements for professional training may be stated separately in the applicable course description or enrollment materials.

4. Website Information

The information on the Site is provided for general educational and informational purposes.

Descriptions, photographs, healed results, timelines, frequently asked questions, and aftercare information are intended to explain our services but do not guarantee that every client will experience the same result.

Permanent makeup results may vary based on factors including skin type, skin condition, lifestyle, health history, medications, aftercare, pigment retention, and individual healing.

Website content is not medical advice and should not replace consultation with a licensed healthcare professional.

5. Consultations and Service Eligibility

Submitting an inquiry, consultation request, photograph, or booking request does not guarantee that a service will be performed.

Alena Brow Art may decline, postpone, modify, or discontinue a procedure when it is considered inappropriate or unsafe based on the client’s skin condition, health information, previous permanent makeup, expectations, or other relevant circumstances.

Final eligibility may be determined after reviewing the required intake and consent forms and examining the treatment area.

6. Appointments, Deposits, and Payments

Appointments may be scheduled through Square or another booking platform linked from the Site.

A deposit or advance payment may be required to reserve an appointment, model session, workshop, or training. The amount and applicable payment terms will be shown during booking or communicated before payment.

By completing a booking, you agree to the cancellation, rescheduling, late-arrival, no-show, deposit, and payment terms presented during booking or included in your confirmation.

Payments are processed by third-party payment providers. Alena Brow Art does not directly store complete payment-card information on the Site.

7. Cancellations, Rescheduling, and Late Arrivals

Cancellation and rescheduling requirements may vary depending on the service, model appointment, workshop, or training.

The specific policy presented during booking or enrollment applies to that booking. Deposits may be non-refundable when clearly disclosed before payment.

Late arrival may reduce the available appointment time or require the appointment to be rescheduled when there is not enough time to perform the service safely and properly.

Failure to attend an appointment without the required notice may result in the loss of the deposit or payment, as stated in the applicable booking policy.

8. Permanent Makeup Procedures

Before receiving a permanent makeup procedure, clients may be required to complete separate intake, medical-history, informed-consent, photography-consent, and aftercare forms.

Those forms are part of the agreement governing the actual procedure. If there is a conflict between these general website Terms and a procedure-specific consent or booking policy, the procedure-specific document will control with respect to that procedure.

Permanent makeup involves implantation of pigment into the skin and may require more than one session. A touch-up, refinement, or refresh is not automatically included unless specifically stated in the booking description.

No particular healed result, pigment retention, symmetry, duration, or number of sessions is guaranteed.

9. Models and Promotional Appointments

Model appointments may be offered at a reduced rate in exchange for specific conditions disclosed before booking.

These conditions may include permission to photograph or record the procedure and results, availability for follow-up or healed-result photographs, and compliance with designated appointment dates and aftercare instructions.

Any photography or video authorization will be governed by a separate consent form. Booking a standard appointment alone does not automatically grant Alena Brow Art permission to use a client’s image for marketing.

10. Training, Workshops, and Educational Materials

Training programs, workshops, demonstrations, mentorship, and educational materials are provided for professional education.

Program format, schedule, curriculum, included materials, payment schedule, cancellation terms, and prerequisites may be stated in a separate enrollment agreement or course description.

Completion of training does not guarantee licensing, certification by a government authority, employment, income, business success, or legal authorization to perform permanent makeup in any particular jurisdiction.

Students are responsible for determining and complying with the licensing, health, insurance, business, and professional requirements that apply where they intend to work.

Training materials may not be copied, recorded, shared, resold, published, uploaded, or distributed without prior written permission.

11. Intellectual Property

Unless otherwise stated, the Site and its original content, including text, branding, logos, graphics, photographs, videos, course materials, layouts, and educational content, are owned by or licensed to Alena Brow Art.

You may view the Site and save or print limited information for personal, non-commercial use.

You may not reproduce, modify, republish, distribute, sell, imitate, scrape, commercially exploit, or create derivative works from Site content without prior written permission.

12. Reviews and Materials Submitted by Users

You may voluntarily submit inquiries, reviews, testimonials, photographs, or other materials.

You represent that any material you submit is truthful, that you have the right to provide it, and that it does not violate another person’s rights.

Submitting material through a private form or message does not automatically give Alena Brow Art permission to use your photograph or likeness publicly. Public use of identifiable client photographs or videos will be governed by the applicable consent or release.

Reviews voluntarily posted on independent public platforms remain subject to the rules and terms of those platforms.

13. Acceptable Use

You may not use the Site to:

  • violate applicable law;
  • submit false, misleading, threatening, abusive, or unlawful material;
  • introduce malware, viruses, or harmful code;
  • interfere with the Site’s security or operation;
  • attempt to gain unauthorized access to the Site or its systems;
  • scrape or collect Site content or personal information through unauthorized automated means;
  • impersonate another person or misrepresent your identity or affiliation.

We may restrict access to the Site when reasonably necessary to protect the Site, its users, or the business.

14. Third-Party Services and Links

The Site may link to or interact with third-party services, including booking, payment, mapping, analytics, social-media, and communication platforms.

Third-party services operate under their own terms and privacy practices. Alena Brow Art does not control and is not responsible for the availability, security, content, or independent practices of those services.

Use of Square or another external booking or payment platform may also be subject to that provider’s terms.

15. Privacy and Cookies

Information collected through the Site is handled as described in our Privacy Policy.

The Site may use essential, analytics, functional, and other cookies or similar technologies as described in our Cookie Policy and Cookie Settings.

16. Website Availability

We aim to keep the Site accurate and available, but we do not guarantee that it will always be uninterrupted, complete, secure, or free from technical errors.

We may update, suspend, remove, or change Site content or functionality when reasonably necessary.

17. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis.

Alena Brow Art makes no warranty that the Site will meet every user’s requirements or that all Site content will remain current, uninterrupted, or error-free.

Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.

To the fullest extent permitted by applicable law, Alena Brow Art will not be liable for indirect, incidental, special, or consequential losses arising solely from the use of, or inability to use, the Site.

This limitation does not apply where liability cannot legally be excluded or limited.

These website Terms do not replace or eliminate any rights or responsibilities established by applicable law or by a separate service, consent, booking, or training agreement.

19. Indemnification

You agree to be responsible for losses or claims reasonably arising from your unlawful misuse of the Site, your violation of these Terms, or material you submit in violation of another person’s rights.

This provision applies only to the extent permitted by law.

20. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute relating to these Terms or use of the Site will be handled in a court with proper jurisdiction in New York, unless applicable law requires otherwise.

21. Changes to These Terms

We may revise these Terms when our Site, services, business practices, or legal obligations change.

The revised version will be posted on this page with an updated “Last Updated” date. Changes apply prospectively from the date they are posted unless otherwise stated.

22. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
